1. Introduction

Welcome to LEGACY.

LEGACY is an online platform designed to connect tourists and visitors with licensed tour guides, enabling them to discover, book, and pay for available tourism experiences and guided tours electronically.

LEGACY operates as a technology-based intermediary platform between tourists and tour guides and does not directly provide tourism services unless explicitly stated otherwise in the description of a specific service.

By using the platform, creating an account, or booking any service, you acknowledge that you have read, understood, and agreed to comply with these Terms and Conditions.

If you do not agree to these Terms, please refrain from using the platform.

2. Definitions

For the purposes of these Terms and Conditions, the following terms shall have the meanings set out below:

“LEGACY,” “Platform,” or “We”: The LEGACY platform, owned and operated by Erth Al-Hayah Tourism Establishment (مؤسسة إرث الحياهـ للسياحة).

“User”: Any individual who uses the platform, whether as a tourist, tour guide, or other user.

“Tourist”: An individual who uses the platform to search for or book a tourism service or experience.

“Tour Guide”: A tour guide registered on LEGACY who provides tourism services as an independent service provider in accordance with applicable licensing and regulatory requirements.

“Service” or “Tour”: A tourism experience or guided tour offered by a tour guide through the platform.

“Booking”: The process of requesting and reserving a tourism service through the platform.

“Booking Amount”: The amount payable for the service as displayed to the tourist before completing the booking, including any applicable fees or taxes that have been disclosed.

“Commission”: The percentage or amount payable to LEGACY in exchange for its intermediary and platform services.

“Basic Plan”: The free plan available to tour guides, providing access to the platform’s essential features.

“Premium Plan”: Paid subscription plans that may offer tour guides additional features and benefits according to the details of each plan.

3. Nature and Role of LEGACY

LEGACY provides a technology platform that facilitates the discovery of tourism services, bookings, payments, communication, and booking management.
The tour guide is the tourism service provider and is responsible for conducting the tour and delivering the service booked by the tourist.
LEGACY is not the direct provider of tourism services and does not replace the tour guide in delivering such services.
LEGACY may verify certain information or documents submitted by tour guides before allowing them to use the platform. However, such verification does not constitute an absolute guarantee of the quality of any service or the outcome of any experience.
LEGACY reserves the right to review services, content, and accounts and take appropriate action to maintain service quality or address violations of applicable laws or these Terms and Conditions.

4. Registration and Account Creation

Users must provide accurate, complete, and up-to-date information.
Users are responsible for keeping their account information updated.
Users must not create accounts using another person’s identity or impersonate others.
Users are responsible for maintaining the confidentiality of their login credentials.
Users must immediately notify LEGACY if they suspect unauthorized access to or use of their accounts.
LEGACY may request additional documents or information to verify a user’s identity, eligibility, or the accuracy of the information provided.

5. Eligibility to Use the Platform

By using the platform, users confirm that they are legally eligible to access its services and enter into agreements related to the services they book.

If a user accesses the platform on behalf of another individual or a group, they confirm that they are authorized to do so.

For minors, applicable legal requirements and parental or guardian consent shall apply whenever required.

6. Tourism Services

Tour guides are responsible for providing details of their services, including:

Tour name.
Description.
Location.
Date and time.
Duration.
Price.
Available languages.
Minimum or maximum number of participants.
Requirements and restrictions.
Difficulty level.
Any additional fees.

Tour guides are responsible for ensuring the accuracy of all information related to their services.

LEGACY reserves the right to modify, suspend, or remove any content or service that violates applicable laws or platform policies.

7. Bookings

Tourists must review all booking details before confirming a reservation.
Bookings are confirmed according to the status displayed on the platform and upon completion of the applicable booking and payment requirements.
By completing a booking, the tourist agrees to the displayed service details.
Certain services may be subject to additional conditions specified by the tour guide before the booking is completed.

8. Payments

Booking amounts must be paid through the payment methods available on LEGACY.
LEGACY collects booking payments electronically from tourists through authorized payment service providers.
Booking-related funds are allocated, and payments owed to tour guides are settled in accordance with LEGACY’s financial procedures.
Following completion of a tour, the tour guide’s earnings will be settled according to the applicable settlement cycle, which is currently four (4) days from the date of service completion, unless there is a dispute, refund request, suspected fraud, violation, or any legal or operational reason requiring the settlement to be suspended.
LEGACY deducts the applicable commission and fees according to the agreement entered into with the tour guide before transferring the net amount payable.

9. LEGACY Commission

LEGACY is entitled to receive a commission on bookings made through the platform, based on the percentage or amount specified in the tour guide agreement.

Applicable Commission Rate: 20%

LEGACY may modify the commission rate or structure in the future, provided that such changes are disclosed to tour guides before taking effect.

10. Free and Premium Plans

LEGACY provides tour guides with a free Basic Plan, offering the features described on the platform.
LEGACY may offer paid Premium Plans with additional features and benefits.
Premium features and subscription prices vary depending on the selected plan.
Subscribing to a Premium Plan does not guarantee a specific number of bookings or level of income.
LEGACY may modify or enhance Premium features as permitted by the applicable Terms and laws, with notification to subscribers when necessary.
Premium subscription fees are subject to the payment and refund policy disclosed at the time of subscription.

11. Cancellations and Refunds

The cancellation policy displayed to the tourist at the time of booking shall apply.

Unless a different cancellation policy is specified for a particular service, the following standard policy applies:

More than 48 hours before the tour	100%
Between 24 and 48 hours before the tour	75%
Less than 24 hours before the tour	0%

Exceptions may apply in certain circumstances, including cancellations by the tour guide, force majeure events, or cases governed by applicable laws or specific service policies.

Any applicable refund will be determined based on the booking circumstances and the policy in effect at the time the booking was completed.

12. Cancellation by the Tour Guide

If a tour guide cancels a booking, LEGACY may:

Attempt to arrange an alternative tour guide.
Reschedule the tour with the tourist’s consent.
Refund the booking amount according to the applicable policy.
Take action against the tour guide’s account in cases of repeated cancellations.

13. Late Arrivals and No-Shows

Both tour guides and tourists are required to arrive at the time and location specified in the booking.

Late arrivals and failure to attend are subject to the applicable booking and service policies.

14. Ratings and Reviews

Tourists may rate and review tours after completing their experiences.

All ratings and reviews must be genuine and based on actual experiences.

The following activities are prohibited:

Purchasing fake reviews.
Manipulating ratings or reviews.
Threatening individuals because of their reviews.
Publishing personal information.
Defamation.
Posting offensive or unlawful content.

LEGACY reserves the right to remove content that violates these requirements.

15. User-Generated Content

By uploading photos, videos, text, or any other content to the platform, users confirm that they own or have obtained the necessary rights to use such content.

Users grant LEGACY a non-exclusive right to use the content to the extent necessary to operate and market the services and platform, in accordance with applicable Terms and policies.

16. Intellectual Property

All intellectual property rights associated with the LEGACY platform, including its name, logo, design, software, interfaces, and original content, are owned by or licensed to LEGACY.

Such materials may not be copied, exploited, or redistributed without prior authorization.

17. Prohibited Conduct

Users are prohibited from using the platform:

For unlawful purposes.
To impersonate another person.
To engage in fraudulent activities.
To circumvent the platform’s payment system.
To misuse other users’ personal data.
To hack, disrupt, or interfere with the platform.
To publish content that violates applicable laws or platform policies.
To engage in discrimination, threats, or harassment.
To bypass LEGACY to complete bookings in a manner that violates the applicable agreement.

18. Data Protection

LEGACY processes personal data in accordance with the Personal Data Protection Law (PDPL) and related regulations of the Kingdom of Saudi Arabia.

This includes any information that can directly or indirectly identify an individual.

The platform’s separate Privacy Policy provides further details regarding the collection, use, sharing, retention, and protection of personal data, as well as data subject rights.

Whenever possible, complaints should include the booking reference number, a description of the issue, and any relevant supporting documentation.

20. Account Suspension or Termination

LEGACY may suspend or terminate a user’s account in the following circumstances:

Violation of these Terms and Conditions.
Submission of false or inaccurate information.
Fraud or attempted fraud.
Misuse of the platform.
Violation of applicable laws or regulations.
Causing harm to other users or the platform.

21. Limitation of LEGACY’s Liability

Subject to any rights or liabilities that cannot legally be excluded or limited:

21.1. LEGACY is an intermediary platform and not the direct provider of tourism services.

21.2. The tour guide is responsible for delivering the tourism services they offer.

21.3. LEGACY does not guarantee that any service will meet all the tourist’s personal expectations.

21.4. LEGACY shall not be responsible for events beyond its reasonable control.

21.5. Nothing in these Terms and Conditions shall be interpreted as excluding or limiting any liability imposed by mandatory applicable laws.

22. Force Majeure and Exceptional Circumstances

In the event of circumstances beyond reasonable control, including natural disasters, government decisions, site closures, security situations, or emergencies, LEGACY and the tour guide shall take reasonable measures to address the affected booking in accordance with applicable laws and policies.

23. Amendments to the Terms and Conditions

LEGACY may update these Terms and Conditions from time to time.

Any amendments shall take effect on the date specified in the updated version, with appropriate notification provided whenever required.

24. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by the applicable laws and regulations of the Kingdom of Saudi Arabia.

The competent judicial authorities in the Kingdom of Saudi Arabia shall have jurisdiction over disputes arising from these Terms, unless otherwise provided by law.
